California's Supreme Court ruled 4-3 that the voter-approved prohibition against same-sex marriage was unconstitutional. Mayor Villaraigosa praised the ruling as the "right thing to do," and Gov. Arnold Schwarzenegger said he would follow the court's direction and repeated his opposition to a constitutional amendment banning gay marriage that could be on the November ballot here. i just read in the bbc news that the california courts have overturned the gay marriage ban. why did i have to read this from another country when i live in california?! (actually it's 'cos i have a bbc news feed that i check.) regardless, this is an exciting day. it's still a very fragile decision--it takes 30 days to go into effect. but it's slowly moving me to be unable to even express myself in words. that is why i'm linking over the new york times article on the matter because there are hundreds of comments left there both in support and against.

I just got back from a great lunch with the Rev. Scott Wells, of Boy in the Bands fame. Getting to meet so many bloggers and others folks I've known online for years is one of my favorite parts of traveling, and this summer in DC should be unusually good in that regard. ( Lee , we've still got to go out for a beer. )
In other news from around the Internet, NYT and everyone else is reporting that California's Supreme Court has overturned a ban on same-sex marriage as unconstitutional. California has been particularly odd because no one branch of government seemed to want to take ownership of this issue.

The peculiarities of the California situation leaven that conflict for me somewhat, though. It's hard to argue that the courts are overturning the legislature in this case when the legislature already passed same-sex marriage . What's more, Arnold Schwarzenegger's office said that one of the reasons that he vetoed it was because the courts should decide the matter! Thus judicial activism provides useful cover for politicians who prefer to punt on specific issues. That seems to me to be part of the problem, but it's certainly a different problem than the one judicial activism usually poses.

Same sex couples can now legally marry in California ! A domestic partnership option for gay couples was already in place, but the California Supreme Court today struck down state laws that limited marriage to a union between a man and a woman.
That brings the number of states to have legalized gay marriage to a grand total of two (California and Massachusetts), but with the current trend of constitutional amendments being brought in to "defend" the institution of marriage, it's nice to hear some good news on the queer civil rights front across the border.

Was going to post something morose about Edwards endoring Obama . Don't get me wrong, it's a good thing, especially given that this looks like the runup to an Obama/Edwards ticket. I like Edwards; he quit too soon. But I can't help but reflect on the fact that not so long ago I liked Hillary Clinton more. There was a time when I would've been ecstatic over the idea of an Obama/Clinton ticket, because nuances (and the actual politicians) aside, I think a successful campaign by a black man and a white woman could've signalled a real ideological shift in this country.

The California Supreme Court, in a 4-3 vote, has interpreted the state's constitution in such a way as to preclude limiting marriage to heterosexual couples. This is just the first act in the play. The citizens of California will now amend their constitution to define "marriage" in the traditional way. Bet on it. The same thing will happen in Massachusetts when the matter is brought to a vote.

I have become an activist of sorts because I want my child to have the right to a legal marriage. Today California became the second state in our union to recognize that gay people have the right to marry. Two years ago, I wouldn't have really cared one way or the other. I never was "against" it, but I certainly did not see the fuss thinking that as long as people had the right to a legal partnership all was well. All was not well, and I learned that a legal partnership still does not provide a gay couple with the rights and protection of marriage.
