Does this mean we'll be seeing gay marriages right here in L.A.?
I honestly was starting to think I wasn't going to see this in my lifetime… of course, the case will likely be appealed to the U.S. Supreme Court. Then again, the Supremes have been avoiding this subject for a while… so what does this mean?
In a 4-3 ruling, the justices rule that state marriage laws are unconstitutional.
SAN FRANCISCO -- - The California Supreme Court ruled today that same-sex couples should be permitted to marry, rejecting state marriage laws as discriminatory.

AP:
In a monumental victory for the gay rights movement, the California Supreme Court overturned a voter-approved ban on gay marriage Thursday in a ruling that would allow same-sex couples in the nation's biggest state to tie the knot.
Domestic partnerships are not a good enough substitute for marriage, the justices ruled 4-3 in an opinion written by Chief Justice Ron George.
CNN:
With the ruling, California becomes the second state to allow same-sex couples to legally wed. Massachusetts adopted the practice in 2004, and couples don't need to be state residents to wed there.

Great news out of California today: In a much-anticipated ruling issued Thursday, the California Supreme
Court struck down the state's ban on same-sex marriage as
unconstitutional. This vindicates Mayor Gavin Newsome's courageous decision to buck California's so-called Defense of Marriage Act and issue marriage licenses to gay and lesbian couples. Sometimes you have to do what seems like breaking the law to advance civil rights. Martin Luther King would approve.
Here's the nut of the decision, which roots gay marriage firmly within a person's fundamental, individual, inalienable rights:

Attention married Californians: Did you wake up this morning, lying in bed next to your spouse, feeling… different ? Did you and your spouse have rocky morning? Did you get into a fight? Did you or your spouse say the dreaded words, "I want a divorce" or "I don't love you anymore"? Is your marriage threatened ?
No? Well that's because the right-wing, "pro-family" conservatives were wrong.
I'll let you all in on a little secret: Same-Sex marriage does not harm or threaten "traditional" marriages between a man and a woman!

Anyway, Bill Mears of CNN reports that: An appeal to the U.S. Supreme Court is likely. The federal high court has never addressed the question of same-sex marriage. Why did he say that? Did the California Supreme Court rely on the United States constitution?

In a much-anticipated ruling issued Thursday, the California Supreme Court struck down the states ban on same-sex marriage as unconstitutional.
Several gay and lesbian couples, along with the city of San Francisco and gay rights groups, sued to overturn state laws allowing only marriages between a man and a woman.
"There can be no doubt that extending the designation of marriage to same-sex couples, rather than denying it to all couples, is the equal protection remedy that is most consistent with our states general legislative policy and preference," said the 120-page ruling.

This isn't gaming related, but is very important to us here at GayGamer. At just after 10am this morning. The California Supreme Court ruled that the state ban (approved by voters in 2000) on same-sex marriage was unconstitutional.
The California legislature has since passed laws to make gay marriage legal, twice . State Governor Arnold Schwarzenegger has vetoed them each time, saying that the issue needed to be decided by the courts. However, in 2004, San Francisco mayor Gavin Newsom (god bless him) authorised same-sex marriage licences, claiming existing legislation was discriminatory.

This will be interesting to see how all the other states will react. This establishes precedent and I expect that there will be other suits against other states that allowed blatant discrimination to be voted into law. CNN's story: here .
I imagine if the SCOTUS affirms the decision that will only help the cause.

"In contrast to earlier times, our state now recognizes that an individual's capacity to establish a loving and long-term committed relationship with another person and responsibly to care for and raise children does not depend upon the individual's sexual orientation," the court said in the 120-page ruling, "and, more generally, that an individual's sexual orientation -- like a person's race or gender -- does not constitute a legitimate basis upon which to deny or withhold legal rights.

In sports, they always discuss "game changing moments" that determine the outcome of a game. In politics, we are seeing "game changing moments" in the Presidential election that have spurred major changes in each contest. On the Republican side, in December, shortly after the assassination of Benazir Bhutto, Michael Barone noted that this could affect how the election was conducted. As we learned, it was the "game changing moment" that gave McCain the victory on the pachydermal side of the electoral situation.

In a 4-3 120-page ruling issue, justices wrote "responsibly to care for and raise children does not depend upon the individual's sexual orientation."
"We therefore conclude that in view of the substance and significance of the fundamental constitutional right to form a family relationship, the California Constitution properly must be interpreted to guarantee this basic civil right to all Californians, whether gay or heterosexual, and to same-sex couples as well as to opposite-sex couples," Chief Justice Ronald George wrote for the majority.

California ban on same-sex marriage struck down
(CNN) -- In a much-anticipated 4-3 ruling issued Thursday, the California Supreme Court struck down the state's ban on same-sex marriage as unconstitutional
The ruling clears the way for the state to become the second to legalize same-sex marriage.
Several gay and lesbian couples -- along with the city of San Francisco and gay rights groups -- had sued, saying they were victims of unlawful discrimination.
A lower court ruled San Francisco acted unlawfully in issuing marriage licenses to same-sex couples, but Thursday's ruling overturned that decision.

The Supreme Fools of the People's Republic of Kalifornia have struck down the ban on same-sex marriage. (Same-sex marriage; there is an oxymoron for you.) I can't really say that I am surprised. The left-coast is, well, the left-coast and has been for some time. The cultural elite has been working on changing the cultural (and all other) positions on homosexuality for some time (at least since the late 1960s). Unfortunately, too many of us have been sitting on our posteriors, laughing at Will and Grace or Queer Eye .

Q. Do you think this has been a particularly racist campaign?
A. I do not. I think this has been a positive, civil campaign. I think that both gender and race have been obviously a part of it because of who we are and every poll I've seen show more people would be reluctant to vote for a woman [than] to vote for an African American, which rarely gets reported on either. The manifestation of some of the sexism that has gone on in this campaign is somehow more respectable or at least more accepted.

That the state legislature would have more important shit to worry about than approving a freakin bible-beatin' license plate . I mean, seriously? Does SC enjoy tap dancing around lines that only seek to divide people? They really ought to review the U.S. Constitution before they make a state-issued plate that endorses a particular religion. Ass backwards.

California's Supreme Court struck down its ban on gay marriage today , calling it unconstitutional. It's exciting that the second state in the union to allow same-sex marriages (after Massachusetts) is on our coast, though unfortunate it isn't right here. Nevertheless, the ruling seems apt, as one of Cali's largest city's is this country's de facto gay capital.
And I do hate to rain on everybody's rainbow ringed parade (I seem to have a bad tendency to do so), but this is a fairly tricky time for this to be happening as well.

The ruling by the California Supreme Court this morning was one of the most hotly anticipated rulings in recent memory. This ruling essentially brought to a close the debate over the legality of same-sex marriages in California. The battle all began in 2004 when San Francisco Mayor Gavin Newsom surprised everyone by issuing marriage licenses to same sex couples in 2004. In the see-saw legal battles that followed, the issue seemed to polarize many, and it seemed no one was void of a view on the matter.

I've been on record in the past regarding the fact that I don't consider myself to be either a conservative or a liberal - and that I have rather disliked those people I have met who identify themselves with such labels. I think that I've also said before that I mean this to apply not only in a political sense, but also in the religious sense as those terms are applied to Catholics. I don't know when "liberal" or "conservative" became valid labels for a system of belief which demands nothing more or less than orthodoxy , but as much as I eschew them in the political arena, I find them even more odious as religious designations; and I look forward to the day when their usage passes .

It's a revolutionary decision. The California State Supreme Court has legalized gay marriage in this state. They've decided, finally, that banning same-sex marriages is just like banning interracial marriage. It's discrimatory and deprives basic rights of human beings for no good reason. Well duh. How narrow, uneducated and brainwashed do you have to be to not see that correlation?
Of course the deep-pocketed and loud-mouthed religious right has mobilized and are already in the process of putting a measure on the ballot to strike down this ruling.
