Good news for fairness, justice and equality: California has made gay marriage legal . It's a small triumph for civil rights.
Now to celebrate, I don't expect you all to run out and marry a same-sex partner - I think my wife would object, and I'm really not in the market - but wouldn't you know it? The media is responding to this news with…stupid internet polls! How else can they possibly trivialize an important court decision, after all?

It's on its way :
The California Supreme Court ruled today that same-sex couples should be permitted to marry, rejecting state marriage laws as discriminatory.
But note:
The state high court's ruling was unlikely to end the debate over gay matrimony in California. A group has circulated petitions for a November ballot initiative that would amend the state Constitution to block same-sex marriage, and the Legislature has twice passed bills to authorize gay marriage. Gov. Arnold Schwarzenegger vetoed both.

California's Supreme Court ruled 4-3 that the voter-approved prohibition against same-sex marriage was unconstitutional. Mayor Villaraigosa praised the ruling as the "right thing to do," and Gov. Arnold Schwarzenegger said he would follow the court's direction and repeated his opposition to a constitutional amendment banning gay marriage that could be on the November ballot here. Quick legal analysis suggests the ruling is based entirely on the state constitution, so cannot be appealed to the U.S.

San Francisco Chronicle :
Gays and lesbians have a constitutional right to marry in California, the state Supreme Court said today in a historic ruling that could be repudiated by the voters in November.
In a 4-3 decision, the justices said the state's ban on same-sex marriage violates the "fundamental constitutional right to form a family relationship." The ruling is likely to flood county courthouses with applications from couples newly eligible to marry when the decision takes effect in 30 days.

This morning's decision by the California Supreme Court means I no longer have to be an unwed father. And for a change, even our Governor is onboard:
I respect the court's decision and as governor, I will uphold its ruling. As I have said in the past, I will not support an amendment to the constitution that would overturn this state supreme court ruling.
Granted, he could have simply signed his name on bills when I asked him , but better late than never.
His quote refers to the dark cloud on the horizon, a ballot initiative to amend the state constitution, which is pretty much the only way to overrule the court at this point.

This being California, there will undoubtedly be a state constitutional amendment initiative to overturn the ruling -- but, on that front, Sullivan notes : One key fact: the ruling takes effect in 30 days
- which means thousands of couples will be able to marry long before
any initiative attempts to reverse it.

I thought gays who wanted to enlist in the military were nuts but I certainly supported their right to be as do what they felt they had to do or wanted to do. Same with marriage. I never could quite understand why people desired to go voluntarily into that prison, especially not gays who had such an ironclad excuse. (I can't remember all the time I told guys that I would love to marry them if only... Oh, yeah, if only it was for a week.) But whether someone is straight or gay, it should be their own choice, certainly not the government's.

Remember all the grief San Francisco mayor Gavin Newsom got for issuing marriage licenses to same-sex couples four years ago? Well …
The long-awaited court opinion, written by Chief Justice Ronald M. George, stemmed from San Francisco's highly publicized same-sex weddings, which in 2004 helped spur a conservative backlash in a presidential election year and a national dialogue over gay rights….

News just broke that the California Supreme Court has overturned the ban on gay marriage that they initially enforced in 2004 after San Francisco Mayor Gavin Newsom gave the green light, opening a month-long window when thousands of gay couples traveled to the Bay Area to get hitched.
The Supreme Court basically said that Newsom couldn't take matters into his own hands, and neither could they until the lower courts acted first. Fast-forward to 2008, and the Supreme Court finally declares "that domestic partnerships are not a good enough substitute for marriage in an opinion written by Chief Justice Ron George," according to the New York Times.

"We are free to marry anyone."
Gov. Arnold Schwarzenegger released a statement immediately after the opinion was issued saying he would uphold the ruling.
"Also, as I have said in the past, I will not support an amendment to the constitution that would overturn this state Supreme Court ruling," he added.

Nicely done , California. You'll get used to the blood coming out of your faucets, and the frogs can be quite endearing. Opponents countered that the ban was gender-neutral, barring both women and men from marrying members of their own sex. Opponents countered that the ban was race-neutral, barring both whites and blacks from marrying members of the other race. They also argued that people could be treated differently because of their sexual orientation if there was a rational basis for it. Sadly, "teh gay = icky" is not a rational basis.

Yesterday the LA Times reported on the California Supreme court's divisive decision concerning same sex marriage:
The California Supreme Court struck down the state's ban on same-sex marriage Thursday in a broadly worded decision that would invalidate virtually any law that discriminates on the basis of sexual orientation.
The 4-3 ruling declared that the state Constitution protects a fundamental "right to marry" that extends equally to same-sex couples. It tossed a highly emotional issue into the election year while opening the way for tens of thousands of gay people to wed in California, starting as early as mid-June.

The California Supreme Court decided today that same-sex couples should be permitted to wed, ruling that gay unions must be given the "respect and dignity" of marriage.

The Massachusetts high court struck down bans on same-sex marriage in 2003, but under a different legal theory. ... "One of the core elements embodied in the state constitutional right to marry is the right of an individual and a couple to have their own official family relationship accorded respect and dignity equal to that accorded the family relationships of other couples," wrote Chief Justice Ronald M.

Of course, the opposition to this is pretty much exclusively religious and exclusively Christian. This year the Lesbian, Gay, Bisexual, and Transgender (LGBT) Pride Celebration & Parade in San Francisco was particularly exuberant. Just days earlier, the California supreme court had struck down the ban on same-sex marriage (6 of its 7 judges are Republican appointees). Newlyweds marched in wedding attire. Gay men ran up to strangers in the crowd and excitedly screamed, "I'm getting married!" If heterosexuals had done the same, I would likely be fighting the sensation to puke. But in the homosexual context, this was powerfully moving and heartening to behold.

The big news right this hour is the California decision on gay marriage , ruling that current state marriage laws discriminate. Personally I've long felt this was overdue, at the same time while I think 'judicial activism' is a wonderfully lame complaint -- after all, it's only 'activism' if it's a decision you don't like, and all but one of the justices was a Republican appointee anyway -- I think there's a larger point to be had regarding getting the right to gay marriage confirmed via a larger vote somehow.
