The California Supreme Court has overturned a ban on gay marriage, paving the way for California to become the second state where gay and lesbian residents can marry. The justices released the 4-3 decision Thursday, saying that domestic partnerships are not a good enough substitute for marriage in an opinion written by Chief Justice Ron George.

One prediction (no magic here): watch for candidates being asked what they think not about the decision and the state law issues but the idea of gay mariage in general.

I wonder what McCain'll say about it? Think he'll call of a Constitutional ban on gay marriage like Bush did? Hmm...
In the meantime, I would say that I would prefer the word "marriage" (and some of the legal benefits) be dropped and the government certify "civil unions" between both inter-sex and same-sex couples. But if we're not going to do that, gay couples should be allowed to enter into the exact same legal arrangements as straight couples and get the same benefits and have it called the same goddamn thing .

The Supreme Court overturned California's ban on gay marriage . So Californian gays may now become legally married (again).
Unless I"m mixing up my legislation, this is a bitch-slap to the Terminator, who vetoed a bill legalizing same-sex marriage a few years ago. I blogged about it here .
It's not legal in every state (yet) but the legal precedence has clearly been shown.

Not the ruling anyone expected . On the whole this is a very dangerous precedent for the institution of marriage. Up until today no other court was willing to embrace the full reasoning of Massachusetts. This had set a series of legal decision in Washington, New York, and other State Supreme Courts denoting a elite legal trend of opinion away from this spurious reasoning. On the upside this should only help the effort to finally amend the California constitution to fully protect marriage . This will also have the expected affect of putting the issue same-sex "marriage" into the 08 presidential campaign as the central social issue.

Harrington has lived with his partner for 35 years and in 2004 Harrington married about 40 same-sex couples.

As Andrew Sullivan pointed out in The Daily Dish , if thousands of same-sex couples marry in California between 15 June (when the decision takes effect) and November, any proposed constitutional amendment to ban same-sex marriage would result in the simultaneous annulment of thousands of marriages. For those who claim to value the sanctity of marriage, I hope this creates room for pause; I imagine that straights would be pretty infuriated if their marriages were annulled at the polls, don't you think?

News just broke that the California Supreme Court has overturned the ban on gay marriage that they initially enforced in 2004 after San Francisco Mayor Gavin Newsom gave the green light, opening a month-long window when thousands of gay couples traveled to the Bay Area to get hitched.
The Supreme Court basically said that Newsom couldn't take matters into his own hands, and neither could they until the lower courts acted first. Fast-forward to 2008, and the Supreme Court finally declares "that domestic partnerships are not a good enough substitute for marriage in an opinion written by Chief Justice Ron George," according to the New York Times.

California Supreme Court overturns gay marriage ban . This will presumably create political headaches for liberals -- John McCain will be able to argue with some plausibility that judges appointed by Barack Obama are likely to make similar rulings (not that there's anything wrong with that, but the voters may feel otherwise) -- but it's a victory for justice.
The smart set thing to do at this point is, I assume, to argue that this is a good outcome but the process is bad.
