Church of Scientology Claims Copyright Infringement [Tom Cruise]
gawker.comFound 185 days, 17 hours, 43 minutes, and 22 seconds agoThe Church of Scientology, and Tom Cruise, the organization's most prominent evangelist, are both notoriously litigious. The sect's founder, science fiction writer L. Ron Hubbard, wrote in a 1955 magazine article, "The purpose of a lawsuit is to harass and discourage rather than to win. ...

Well, in case you hadn't heard the news, we got hit with a copyright infringement notice from the Church Of Scientology earlier today. Frankly, we've been too busy watching repeat after repeat of Defamer's appearance on The Today Show this morning to pay it much mind. After all, that's what they pay lawyers for, right? Anyhoo, we managed to get our paws on another outtake from the DVD from whence the "Freedom Medal Of Valor" speech came*. In it, Tom Cruise helps explain how he saved America after 9/11 .

Seeing as we have been talking about Tom Cruise and Scientology earlier today, there is an interesting ruckus brewing on Gawker , who have posted a rather interesting (in a 'huh?' kind of way) video of Tom Cruise talking about Scientology. The Church of Scientology's lawyers have demanded they take the video down and in response fearless Gawker VP Gaby Darbyshire politely invited them to go rotate, citing 'fair use' (Gaby is delightful and rather hot, by the way. I met her at Les Blogs in Paris a few years ago).

Yesterday's Gawker posting of a Tom Cruise Scientology " indoctrination video " spread like wildfire* through the internets. It is difficult to say what the enduring fascination is for this not-terribly-capable actor or his absurd ersatz religion.** Cruise' assertion that "when a scientologist drives by an accident, we have to stop, because we know we're the only ones who can help" is, as WWTDD put it, "just about the most horrible mental image I've ever had". Today, as the sun follows the rain***, the Church of Scientology has filed a lawsuit against Gawker for copyright infringement (hat tip to Agent Bedhead ).

Click to watch an extremely interesting video that was probably not intended for public consumption, because it demonstrates just what a delusional, narcissistic dick this man is, and also reveals some secret Scientology mumbo-lingo (or is that lingo-jumbo…?)
NB: None of what is written in this post is to be taken as fact. This is in fact a parody of the sort of post that might attempt to smear Mr Cruise by implying that he is an obnoxious lunatic who believes himself superior to humans from Earth.

Tom Cruise Scientology Indoctrination Video . Ye gods, this is the most frightening thing you'll see today. Ten minutes of Cruise preaching the gospel of L Ron. Eek! Thank you Brother Jez .
Later: Gawker get the inevitable C&D and decide to fight it.

Has Nick Denton gone too far? The new-media minimogul is notorious for poking New York media types in the eye. But now he is accused of ambushing a publisher's daughter by using her Facebook entry in an unflattering and unwarranted item on his media-industry blogsite, Gawker. In the process, he has violated Facebook's terms of use, and the social network's honchos are not amused. Gawker : Scientology claims copyright infringement over Tom Cruise video posted by Gawker.

And if you've ever seen the size of Denton's head, you know they're in trouble! Gawker and Defamer are among the few places that haven't been taking down the amazingly crazy Tom Cruise videos ("If you're in a car accident and there aren't any Scientologists around, nobody can save you") as soon as somebody puts them up. So now some Scientology lawyer has asked him to take down the videos for copyright infringement, and here was Gawker Media's reply:

The Scientology video we first published on Tuesday of Tom Cruise pushing his religion has since been taken off YouTube. Evidently this leaked video is something the alien-haters didn't want us to see!
On Monday, celebrity gossip site Gawker.com , received a letter from the Scientologists claiming the video was stolen from one of their churches.
If this really is a Scientology recruiting video, why does the church want to keep it from us so badly? An unauthorized biography about Cruise also released on Tuesday claims Tom is the second in command among Scientologist.

In an earlier post we told you about the bizarre Tom Cruise / Scientology video, which has been doing vanishing acts all over the internet, most likely as fast as Church of Scientology lawyers can send out DMCA notices to stop its proliferation. Gawker.com nailed down a copy of the video and posted it on their site yesterday, hosting it on their servers to avoid it self-destructing. "It's newsworthy; and we will not be removing it," they stated.

The path to salvation and happiness comes with a price. Just ask Tom Cruise and his fellow Scientologists. If one of your concerns is organizations making money from your misfortunes, then Scientology is not for you. See actor Tom Cruise sell L. Ron Hubbard's vision to the appropriately educated for free for a potentially limited time ; beware the body Thetans unleashed by Xenu.

Gawker is hosting a controversial Tom Cruise Scientology video that other sites were forced to remove after legal threats from the Church of Scientology. In the Cruise video, high-energy music plays while Cruise gives forth a stream of claims about the powers and responsibilities of people who've been turned into mystical beings by the cult's teachings.
The Church has sent a legal threat to Gawker as well, alleging that hosting the video infringes copyright (amid a host of nonsensical allegations about "receiving stolen property"), but Gawker's refused to take the video down.

Two days ago Gawker.com posted an interesting video of Tom Cruise talking about Scientology . Apparently this was on youtube for a little while but it was removed, probably because the Church of Scientology objected.
Gawker has said they will keep the video up no matter what the Church of Scientology says because it's newsworthy. As they predicted, they did receive a notice of copyright infringement from the Church of Scientology yesterday.
For those who prefer transcripts, here's a transcript of the Tom Cruise video .

I attempted to leave the below comment at this thread on Gawker but it hasn't yet appeared, so I'll just post it here as well. The post includes a cease and desist letter from Ava Paquette and a reply by Gawker's lawyer and VP, Gaby Darbyshire, claiming fair use.

A few points regarding fair use here. As others have pointed out, fair use is not quantifiable and is usually considered within a larger context (and varies court to court, minute to minute, etc.). One point in Denton's favor is that the 9+ minute clip is part of a 1 hour video; it is an excerpt, despite the new life it's taken on as 'that creepy Tom Cruise video.

Tyler Durden has Cruise's acceptance speech too, if you're interested. Meanwhile, boingboing has a little piece up about Gawker's fight to keep up the videos I linked to in the previous post. Gawker, a company that owns a whole bunch of popular blogs, is the only site on The Tubes that has refused to take the videos down at Scientology's request. Stay strong, Gawker!

I just finished watching Tom Cruise's Scientology video that surfaced on the internet a few days ago. Now I'm sitting at my desk in a state of… something; awe, shock, dumbfoundedness (if that's even a word)… I'm not even sure what I'm feeling. Never have I seen someone talk so much and never really say anything. ( With the possible exception of the State of the Union Addresses for the last 7 years. ) If you haven't seen it I strongly suggest that you take a peek sooner rather than later since the CSI is doing what they can to have all traces of it removed from the internet as swiftly as possible.

Someone should remind those Scientologist nutjobs : that's just not how the internet works .
